Client terms
Terms and Conditions
The terms that apply when you use the Big Accountants website and engage us for bookkeeping, accounting, tax or advisory services.
The terms and conditions at a glance
Your signed engagement letter sets scope and fees, and prevails over these terms if they conflict.
Articles and guides on this site are not professional advice for your situation.
You review and approve returns and reports before they are filed or relied on.
These terms are governed by the laws of India, with courts at Kochi, Kerala.
About these terms and conditions
These terms and conditions apply to your use of bigaccountants.com and to the services Big Accountants provides. The website and services are operated by Great Inventh Private Limited, referred to here as Big Accountants, we, us or our.
By using the website or engaging our services, you agree to these terms. Our Privacy Policy and Cancellation and Refund Policy form part of these terms. If you do not agree, please do not use the website.
Where you have a signed engagement letter, proposal or service agreement with us, it sets the scope, fees and terms of that engagement and takes precedence over these terms if the two conflict. These terms apply to anything it does not cover.
Use of the website
You may use the website only for lawful purposes. You must not:
- use the website in a way that breaks any law or regulation;
- send or upload anything harmful, unlawful, misleading or disruptive, including malware;
- try to gain unauthorized access to the website, its servers or any connected system; or
- interfere with the operation or security of the website.
Website content is general information
Articles, guides, calculators and other content on this website are general information. They are not accounting, tax, legal or financial advice for your situation, and reading them does not create a client relationship with us.
Tax rules, rates and deadlines change, and they differ by jurisdiction. Please do not act on website content without advice on your specific facts. A client relationship starts only when we both agree to an engagement in writing.
Our accounting and tax services
We provide bookkeeping, accounts payable, accounts receivable, controller services, financial reporting, business intelligence, virtual CFO services, tax preparation and filing, consulting and advisory, and accounting software implementation and support. The scope of each engagement is set in your engagement letter or proposal.
Unless your engagement letter expressly says otherwise, our services:
- do not include an audit, a review or any other engagement that results in an assurance report on your financial statements;
- do not include legal advice or legal opinions;
- do not include representing you before the IRS or any other tax authority; and
- are not designed to detect fraud, errors or illegal acts, although we will tell you about any we become aware of.
Your responsibilities as a client
- Information. You give us complete, accurate and timely records and information. Our work relies on what you provide, and we do not verify it unless agreed.
- Management decisions. You are responsible for your financial statements, internal controls, business decisions, and approving transactions and payments.
- Review and approval. You review and approve returns, reports and filings before they are filed or relied on. You remain responsible for the accuracy of any return you sign.
- System access. You grant us access to the systems we need, with appropriate permissions, and tell us promptly when that access should change.
- Deadlines. Filing and payment deadlines depend on you providing documents and approvals in time. We are not responsible for penalties or interest caused by late, incomplete or inaccurate information from you.
- Original records. You keep your original records. We are not your system of record retention unless your engagement letter says so.
Fees and payment
We offer competitive pricing under three models: a fixed monthly fee, hourly billing, or per task and project pricing. The model, fees and payment terms for your engagement are set in your engagement letter, proposal or invoice.
- Invoices are payable on the terms stated on them or in your engagement letter.
- Where an account is overdue, we may pause work after giving you written notice, and resume once the account is brought up to date.
- Third party costs, such as software subscriptions and government filing fees, are paid by you directly or passed through as agreed in writing.
- Cancellations and refunds are governed by our Cancellation and Refund Policy.
Confidentiality
We keep your information confidential. We disclose it only as needed to deliver your services, as the law or professional standards require, or as you authorize.
Tax return information is protected by section 7216 of the Internal Revenue Code and is handled under the consent rules described in our Privacy Policy.
Use of technology and AI tools
We use accounting software, automation and AI tools to work faster and more consistently. AI may prepare a first pass on tasks such as transaction categorization or document extraction, and a member of our team reviews the output before it is delivered to you or relied on. These tools are used under our information security program.
Intellectual property
- Website content. Text, graphics, logos, icons, images and software on the website belong to Great Inventh Private Limited or its content suppliers and are protected by copyright and other intellectual property laws. You may not copy or reuse them without our written permission.
- Your deliverables. Once paid for, the reports, reconciliations, schedules and other deliverables we prepare for you are yours to use in your business.
- Our methods. We keep ownership of our templates, workflows, tools and general expertise, including improvements we make while working with you.
Your submissions
If you send us content through the website, such as a contact form or feedback, you grant us a worldwide, royalty free license to use, reproduce, modify and display it for our business purposes. Confidential client information is not a submission for this purpose and is handled under section 7 and our Privacy Policy.
Third party links and software
The website may link to other websites, and our services may rely on third party software such as accounting, payroll, banking and tax platforms. We are not responsible for the content, availability or practices of third party websites or software, which are governed by their own terms.
Disclaimer of warranties
The website is provided as is and as available, without warranties of any kind, express or implied. We do not guarantee that the website will be error free, secure or continuously available.
We perform our services with reasonable skill and care, in line with your engagement letter.
Limitation of liability
To the fullest extent the law allows, we are not liable for any damages arising from your use of, or inability to use, the website, including lost profits or lost data.
Our liability for services is as set out in your engagement letter. Nothing in these terms excludes liability that cannot be excluded by law.
Ending an engagement
Either party may end an engagement as set out in your engagement letter and our Cancellation and Refund Policy, which also explains how we return your records and remove our access to your systems.
Governing law and jurisdiction
These terms are governed by the laws of India. Any dispute arising from them is subject to the jurisdiction of the courts at Kochi (Cochin), Kerala, India, unless your engagement letter provides otherwise.
Before starting any formal proceedings, please contact us so we can try to resolve the matter. Unresolved concerns are escalated to senior management for review.
General terms
- If any part of these terms is found unenforceable, the rest remains in effect.
- If we do not enforce a right, we have not waived it.
- These terms, together with your engagement letter and the policies referred to here, are the entire agreement between us on their subject matter.
Changes to these terms
We may revise these terms by updating this page. Changes apply from the date they are posted, and continued use of the website after that date means you accept them. Changes to the terms of an active engagement are agreed with you in writing.
